We serve Berks, Montgomery, Delaware, Chester, and Bucks counties,which
comprises the Philadelphia suburbs. Additionally, we can help Buyer's
locate a Buyer's Agency anywhere in Pennsylvania or in the United States.
What is Buyer Agency
Simply, Buyer Agency or a Buyer's Agent, is an agent who represents only
the buyer in a real estate transaction and who's fiduciary duty is to
legally act in the buyer's best interest, not the sellers interest.
In Pennsylvannia the law requires the buyer to enter into a type of business
relationship outlined in the "Consumer Notice" traditional real estate
offices generally ask the buyer to enter into a buyers agency relationship
with consent that you will enter into a dual agency relationship should
you purchase a property listed with that office. This happens more often
then not. Why enter into a relationship with a 50% chance or better that
you will not have full representation.
Fiduciary Duty is a duty to act for someone else's benefit, while subordinating
one's personal interests to that of the other person. It is the highest
standard of duty implied by law.
Many states, including Pennsylvania, have now changed the laws of agency
to do away with the automatic assumption of subagency and to better protect
the buyer's best interest. This attempt to clarify the agency relationship
has once again become circumvented by the creation of Dual Agency. Dual
agency is a relationship that allows an agent or an office to represent
the seller's best interest and the buyer's best interest at the same time.
A situation with the clear probability for a conflict of interest.
While many real estate companies will claim to have buyer's agents, they
are operating under the Dual Agency relationship. As an Exclusive Buyer's
Brokerage, Buyer's Agents do not represent sellers and do not accept property
listings. Most Exclusive Buyer's Brokers, including Thomas Real Estate,
are members of a Multiple Listing Service or MLS. Along with the local
MLS, in our area this system is called the TReND system, Exclusive Buyer's
Agents can also show buyers For-Sale-By-Owner (FSBO) along with other
homes not listed on an MLS.
John S. Thomas Real Estate does not solicit or seek listings. Our relationship
is created with the Buyer, not the seller. Our duty and loyalty are exclusive
to you, the buyer's best interest. We work to get you the lowest possible
price with the best possible terms.
Anything Less than 100% representation is no representation. We are
opposed to compromising your best interest by asking you to accept Dual
Agency.
